Terms of Service

These Terms of Service (“Terms”) govern your access to and use of eclipsecosmeticsstore.com and the Eclipse Cosmetics mobile application (the “Service”), operated by Eclipse Cosmetics (“we”, “us”, or “our”). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least the age of majority in your jurisdiction to make a purchase. By placing an order you represent that you meet this requirement and are authorized to use any payment method you provide.

2. Your Account

If you create an account, you are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately of any unauthorized use.

3. Products and Pricing

We make every effort to display product details, shade colors, and prices accurately. However, shade appearance may vary depending on your screen and lighting, and we cannot guarantee a perfect color match online. Prices are shown in U.S. dollars and may change without notice. We reserve the right to correct errors and to limit quantities or refuse any order at our discretion.

4. Orders and Payment

Submitting an order is an offer to purchase. An order is only accepted once we send a confirmation and, where applicable, once payment is successfully processed. We may cancel or refuse an order if we suspect fraud, a pricing error, or a violation of these Terms. Payments are processed securely through Stripe.

5. Shipping and Delivery

6. Returns and Refunds

We accept returns of unopened or gently used items within 30 days of purchase, subject to the conditions on our Shipping & Returns page. Refunds are issued to the original payment method once a returned item is received and inspected.

7. Intellectual Property

All content on the Service — including text, graphics, logos, imagery, and product names — is the property of Eclipse Cosmetics or its licensors and is protected by intellectual-property laws. You may not copy, reproduce, or redistribute it without our written permission.

8. User Conduct

You agree not to misuse the Service, including by attempting to disrupt it, submitting false information, infringing others’ rights, or using automated means to access or scrape the Service.

9. Reviews and User Content

If you submit a review or other content, you grant us a non-exclusive, royalty-free license to display and use that content in connection with the Service. You represent that your content is accurate and does not violate any third-party rights.

Cosmetic results vary by individual, and we make no guarantee of specific results.

To the maximum extent permitted by law, Eclipse Cosmetics shall not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service or our products.

12. Indemnification

You agree to indemnify and hold Eclipse Cosmetics harmless from claims, damages, and expenses arising from your use of the Service or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You submit to the exclusive jurisdiction of the courts of Ontario for any dispute arising from these Terms.

14. Changes to These Terms

We may revise these Terms from time to time. The “Last updated” date above reflects the most recent revision. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
